Intellectual Property Rights Workgroup

Introduction

A group of jurists and technology transfer specialists has been appointed within the framework of ERA-PG in order to create intellectual property rules and guidelines in line with the specifics needs of Plant Genomics research and compatible with both the practices of the countries involved in ERA-PG and the national Plant Genomics research networks rules (these national networks are national intiatives aiming at promoting and developing Plant Genomics research in their countries - ERA-PG has for purpose to link these networks at an european level).

The work of the IPR Workgroup for the setting up of these rules and guidelines for the ERA-PG's first call was divided into two phases:

  • The first phase, from May 2005 to January 2006 was dedicated to the drafting of IPR Conditions, which consists of a series of standard rules for Intellectual Property such as those of the EU Commission for the Framework Program 6 (Part C of annex II of the EC Decision C(2003)3834 "Model Contracts for FP6" - see on this page), but adapted to the needs of ERA-PG
  • The second phase, from February to October 2006 was dedicated to building a set of models of Consortium Agreements based on these IPR Conditions

You will find in these pages the IPR Conditions and the models of Consortiums Agreements for the First Call 2006 (Sub Call A and Sub Call B - Sub Call A being the "academic call" of ERA-PG, and Sub Call B the "public-private" one) and for the Second Call 2008. These IPR Conditions and Consortium Agreements are provided to the ERA-PG community in order to help in building the consortium agreements that will govern the collaborative research projects.

The IPR Workgroup is now involved in a new workpackage aimed at proposing legal solutions towards better sharing of data and resources for research purposes in order to create a first step toward a joint management of research results. Documents concerning the results of this new workpackage will be published in due time.

IPR workgroup Workshop 'The legal Aspects of Joint Management in the Plant Genomics Networks', 13th October 2006, Venice, Italy

The workshop on the legal aspects of joint management in the Plant Genomics networks originated from a reflection launched within the Intellectual Property Rights Workgroup of ERA-PG (IPR Workgroup). It was concluded that a better understanding of the composition and policies of intellectual property of the national networks in Plant Genomics would help in pushing forward transnational cooperation.

In the attached report of the workshop, which was held on 13th of October during PlantGEMs 2006 in Venice, you will find the summary of the presentations that were given, which mainly explain the configuration of the national networks and their policies toward intellectual property rights. You will find as well a presentation summarising the survey made on the “Best practices in common research programme” in ERA-PG’s participating countries regarding IPR, as well as three presentations oriented in the political and legal issues of intellectual property rights and joint management. In annex are reproduced the original presentations given during this workshop.
